Terms & Conditions

Last updated:

These terms cover your use of the magpiescraper.com website. The Magpie desktop app is governed by a separate contract — the End-User Licence Agreement you accept in the app — and your purchase is handled by our merchant of record, Polar. This page tells you who you are dealing with and which terms apply to what.

Who we are

This website and the Magpie app are operated by Dominique Degottex, a sole proprietor trading as “Motherlode Lab”, 9462 Ploenchit Road, Apt 917, Pattaya, Pathum Thani 49981, Thailand — “we”, “us”. For everything — support, your rights, security reports — email [email protected] or call +66-31-425-7198.

Which terms apply to you

These website terms apply when you visit magpiescraper.com. There is no account and nothing to accept: using the site means you follow them.

The Magpie app is governed by our End-User Licence Agreement (EULA), which the app presents for acceptance at first launch. It is the contract for the licence, the subscription, the free trial, cancellation, refunds and withdrawal, acceptable use, and how the app may change. If you use the app, the EULA — together with our Privacy Policy, which forms part of it — applies, not these website terms.

Using this website

You may browse and download from this site for lawful purposes. Please don't interfere with its operation, try to break or bypass its security, or misrepresent your identity to us.

The site is provided for information: product descriptions, prices, and trial terms are described accurately but the EULA and the checkout you actually accept are what governs your purchase. We may change the site and these terms from time to time; the “last updated” date above reflects the current revision.

Intellectual property

Unless otherwise stated, the content of this site — text, graphics, logos, screenshots, and code — belongs to us or our licensors and is protected by applicable intellectual-property laws. You may quote and link to it; you may not reproduce or republish it wholesale without permission.

The Magpie app itself is licensed, not sold: what you may do with it is set out in the EULA.

Buying the app

The app is sold and billed by our merchant of record, Polar. Polar handles payment, tax, subscription changes, cancellations, and first-line refunds under its own buyer terms, which the checkout shows you before you pay. The licence to use the app is granted by us, on the terms of the EULA.

Prices, renewal, the free trial, one-computer-per-key, what happens when a subscription lapses, and the EU/UK 14-day withdrawal right are all set out in Section 5 of the EULA and in the checkout — those documents are authoritative, not this summary.

Disclaimers

This website is provided “as is” and “as available”, without warranties of any kind, express or implied. We do not guarantee it will be uninterrupted or error-free, and we do not warrant that third-party sites it links to or describes are available or suitable.

The app's warranty terms — including the consumer carve-outs for EU and UK users — are in Section 11 of the EULA.

Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages arising from your use of, or inability to use, this website. Nothing in these terms limits liability that cannot be limited by law, such as for intent, gross negligence, or personal injury.

Liability for the app is limited as set out in Section 12 of the EULA, with the same carve-outs.

Consumer protections

If you buy as a consumer, the law of your country of residence gives you protections these terms cannot take away, including mandatory warranty rights and the right to bring proceedings in the courts of your country. Where this page and that law conflict, that law wins. Section 14 of the EULA says the same for the app.

Governing law and courts

These website terms are governed by the laws of Thailand. If you are a consumer, you keep the protections of the law of your country of habitual residence and may bring proceedings in the courts of that country, whatever this section says; for non-consumers, the courts of Thailand have exclusive jurisdiction.
